1. Introduction

  • These terms and conditions apply to all services provided by Hive of Remembrance, a subsidiary of Hive of Creatives Ltd. By engaging our services, you agree to the terms outlined below.

2. Services

  • Hive of Remembrance offers funeral stationery and memorial design services, which may include but are not limited to Order of Service Programmes, Big Screen Slideshow Presentations, Digital Notifications, Canvas Prints, and Video Eulogies. Services may be expanded or changed, with advance notice provided to existing clients.

3. Payment Terms

  • Design Payment: A 50% deposit is required upon order confirmation. The remaining balance must be paid before the final design is signed off.
  • Printing Payment: Full payment for printing must be received at least 7 days before the event for standard services or at least 3 days before for basic printing. Services will not proceed without these payments.
  • Handling Delayed Payments from Estates: If you are waiting for funds from an estate, we may offer a payment plan or delayed payment agreement. However, the final product will not be delivered until full payment is received.
  • Late Payment Charges: A late payment fee of £20 may be applied if payments are not made by the agreed-upon date.
  • Right to Withhold Services: We reserve the right to withhold any services or products until full payment is received, especially if delayed payments from estates are involved.
  • Rush Orders: Rush orders are subject to availability and may incur additional fees. Only basic printing services are available for rush orders, and clients must understand the limitations of such orders.

4. Design Sign-Off

  • After the design is completed, a final proof will be emailed to you for review.
  • You are entitled to up to 5 revisions at no additional cost. Further revisions will incur a fee of £20 per revision.
  • A legally binding design sign-off document will be provided electronically via a reputable e-signature service. This document must be signed and returned before the design is sent to print.
  • Once the design is signed off and sent to print, no further changes can be made, and no refunds will be provided.

5. Delivery

  • We offer nationwide delivery of printed materials. For local orders, we will deliver directly to your specified address. For other orders, items will be sent via post with the intent to arrive before the event.
  • Delivery charges are included in your final invoice. Personal collection is not available.
  • We are not liable for any delays caused by courier services or postal systems.

6. Limitation of Liability

  • Hive of Remembrance’s total liability in respect of any service shall not exceed the total amount paid by the client for that service.
  • We are not liable for any losses arising from delays in payment by the client or other issues beyond our control, such as delays from printers or couriers.

7. Dispute Resolution

  • Any disputes arising from the provision of services by Hive of Remembrance shall be resolved through mediation or arbitration before proceeding to legal action. This approach is intended to foster amicable resolution and avoid unnecessary legal expenses.

8. Force Majeure

  • Hive of Remembrance shall not be liable for any failure to perform its obligations where such failure is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, riot, civil commotion, pandemics, government restrictions, or natural disasters.

9. Data Protection and Privacy

  • Data Collection: We collect and process personal data necessary to provide our services, including names, contact information, images, and messages. All personal data is collected, stored, and processed in accordance with the General Data Protection Regulation (GDPR).
  • Data Security: We implement appropriate technical and organisational measures to ensure the security of personal data against unauthorised access, accidental loss, destruction, or damage.
  • Data Usage: Personal data is used solely for the purpose of providing the requested services. We do not share personal data with third parties unless it is necessary for completing your order (e.g., sharing with a printing company), and we will always ensure such third parties are GDPR-compliant.

10. Client Responsibilities

  • Clients are responsible for providing all necessary content (e.g., images, texts) by the specified deadlines to avoid delays. Hive of Remembrance is not responsible for delays caused by the client’s failure to provide necessary materials on time.

11. Refund Policy

  • Once a design has been signed off and sent to print, no refunds will be provided. This policy also applies to any other services rendered or where the client has approved the final design.

12. Confidentiality

  • Hive of Remembrance will protect any personal information shared during the process, ensuring that it is handled with care and respect. We will not disclose any personal details or content provided by the client without explicit permission.

13. Promotional Use of Designs

  • Hive of Remembrance reserves the right to use completed designs for promotional purposes, such as in our portfolio or on our website, unless the client opts out in writing. Clients can opt-out of promotional use at any time by notifying us in writing.

14. Third-Party Suppliers

  • If Hive of Remembrance works with third-party suppliers (e.g., printers, voice-over artists), we are not liable for any delays or issues caused by these third parties. We will manage and oversee the work of third-party suppliers to the best of our ability.

15. Amendments

  • Hive of Remembrance reserves the right to amend these terms and conditions and to update services and prices as necessary. Clients will be given advance notice of any changes, which will apply to future orders.

16. Governing Law

  • These terms and conditions are governed by and construed in accordance with the laws of England, UK.
